Pay Grade: Management

Starting Pay: $81,716.76, Compensation commensurate with experience.

Departmental Mission Statement: The Trial Court Office of Workplace Rights and Compliance works with court users, employees, judges and clerks to create a Trial Court free from unlawful discrimination, harassment, and retaliation regardless of race, color, national origin, ancestry, religious creed, sex, sexual orientation, gender expression, gender identity, disability, mental illness, military service or veteran status, genetics, and/or other protected characteristics.

This position is designated as a management position and is covered by the Trial Court Personnel Policies and Procedures Manual. 

Position Summary: Working for the Director of Workplace Rights and Compliance within the Executive Office of the Trial Court, the Manager of Workplace Rights and Compliance is responsible for supporting the administration of the Trial Court’s Policy Against Discrimination and Harassment and its Complaint Procedures, the Plan for Equal and Fair Employment, and for ensuring that all Trial Court employment activities are in compliance with the Plan as well as all state and federal laws and regulations.
 
The Manager conducts investigations related to allegations of discrimination in any form within the Trial Court, drafts a variety of written reports and investigative summaries, and works closely with appointing authorities and the Chief Justice and Deputy Court Administrators of the seven trial court departments, the Commissioners of Probation and Jury, as well as the Directors of OCM department. The Manager provides advice and guidance to appointing authorities and may engage in informal resolution and formal mediation to resolve issues.
The Manager works closely with the Trial Court Human Resources Department to assist in the hiring process to identify and address areas of underutilization of women and minority candidate pools. The Manager works closely with the Office of Diversity, Experience, Inclusion, and Equity and participates in meetings, workshops and seminars for enhancing diversity within the Trial Court.

Supervision Received: Receives general direction and supervision from the Director of Workplace Rights and Compliance.

Major Duties:

Investigations
  • Investigates in a fair and expeditious manner allegations of discrimination, harassment, and/or retaliation by thoroughly reviewing any written documentation and interviewing the complaining party;

  • Discusses allegations, complaints and other concerns with appropriate manager(s) and appointing authority(s) to determine jurisdiction, scope, and develop an investigation plan;
  • Identifies any individuals with knowledge of the events in an allegation(s) of discrimination or harassment as well as any documentation or other evidence to determine what facts can be gathered about the allegations and to develop appropriate remedies or recommended action;
  • Accurately identifies and addresses issues surrounding an allegation(s) and initiates action to properly address the situation about the allegations;
  • Reviews interview materials, documents, and other evidence to determine in a fair and thorough manner what happened, to prove or disprove some or all of the allegations;
  • Uses the findings of fact as to what happened to conclude whether the conduct was a violation of any directive, policy, procedure or training;
  • Prepares a professional, fair, thorough, and clearly written investigation report in a timely manner
  • Informally resolves concerns when possible and amendable to all relevant parties; engages in facilitated dialogues and mediation when in best interest of parties to do so; will provide training and other measures to remedy the effects of the allegation(s) and prevent its recurrence;
  • Performs other related duties as required and assigned.

Compliance
  • Responsible for enforcing and maintaining the Trial Courts Policy on Discrimination, Harassment and Retaliation and its Procedure and ensures that all civil rights complaints are handled in accordance with Trial Court Policies, Procedures and Protocols;
  • Utilizes case tracking system to monitor cases and analyze trends in complaints;
  • Interacts and collaborates with all Trial Court Departments in order to build relationships that serve as the foundation for cooperation and open dialogue to support policy compliance;
  • Provides technical assistance in collaboration with the Human Resources Department to appointing authorities of the Trial Court and/or other personnel in meeting the requirements of Trial Court Policies and Procedures;
  • Conducts or coordinates equal employment opportunity and civil rights training programs for appointing authorities, supervisors, and other court employees throughout the Trial Court;
  • Provides technical assistance to appointing authorities of the Trial Court and/or other personnel in meeting the requirements of the Trial Court’s Plan for Equal and Fair Employment;
  • Monitors all hires, transfers and promotions, and provides oversight for these transactions to ensure that minorities, women, and all other protected classes are afforded full opportunities for appointments, transfers, and promotions;
  • Participates in meetings, workshops and seminars for enhancing professionalism and supporting the diversity efforts set forth in the Trial Court’s strategic plan and mission statement.

Minimum Requirements: These are the minimum requirements necessary to apply for the position of Manager of Workplace Rights and Compliance:
Bachelor’s degree required and (3) Three years of relevant professional experience advancing workplace diversity is required; experience investigating workplace misconduct/discrimination is strongly preferred; or an equivalent combination of education and professional experience; 
Master’s degree or law degree is also preferred;
Demonstrated ability to draft reports and correspondence concisely, clearly, and logically, and with solid analysis and reasoning skills;
Demonstrated ability to remain neutral and open-minded until the all evidence is objectively analyzed and the findings are established;
Commitment to ensuring full and equal opportunities for employment actions; Working knowledge of business software applications, such as MS Word, Excel, and PowerPoint;
Ability to communicate professionally in both oral and written form; including the ability to perform effective public speaking;
Ability to maintain highly productive working relationships with all Trial Court officials, including judges.
 
Preferred Qualifications: HR Background, MCAD Investigator or EEOC Investigator
